In a significant development, the Federal High Court sitting in Abuja has dismissed a suit challenging the recent #Endbadgovernance protests.
The case, which was filed against the protesters, the Attorney General of the Federation (AGF), the Inspector General of Police (IGP), the Department of State Services (DSS), and the Chiefs of Army and Defence Staff, was struck out due to the plaintiffs’ failure to prosecute diligently.
On Thursday, Justice Peter Lifu terminated the suit after observing the absence of the 17 plaintiffs and 26 defendants in court, as well as the lack of legal representation for both parties.
The suit, which was scheduled for hearing, saw no participation from the plaintiffs, who were drawn from the six geopolitical zones of Nigeria.
The plaintiffs had sought an order from the court to terminate the protests, alleging that their fundamental rights, including freedom of movement, human dignity, right to own property, and economic and social development, were being breached. They also requested the court to compel the AGF, DSS, IGP, and military chiefs to enforce their rights and restrain the protesters.
Justice Lifu expressed surprise at the non-appearance of the plaintiffs and their legal representatives, leading to the dismissal of the case for want of diligent prosecution. The court’s decision underscores the importance of active participation and representation in legal proceedings.
