A Makurdi High Court presided over by Justice T.A. Kume, yesterday, nullified the seven-man committee of the All Progressives Congress (APC) in the state.
The action followed a suit initiated by the embattled APC chairman in Benue State, Austine Agada, challenging the dissolution of the state working committee of the party by the National Working Committee, (NWC).
Justice Kume, in his ruling, held that the dissolution of the exco was not in accordance with the constitution of the party, noting that the NWC’s action equally amounted to gross violation of the rights of fair hearing of the applicants.
He maintained that, “Even in the Garden of Eden, God exemplified the importance of fair hearing by asking questions before taking action against Adam.
“In stark contrast, the National Working Committee denied Agada a fair hearing. It begs the question: Shouldn’t the Committee, as mortal beings, strive to uphold the same standards of justice and fairness demonstrated by God?”
Consequently, the court held that all actions carried out by the seven-man caretaker committee appointed by the national secretariat of the APC to act in place of the Austin Agada-led state working committee amounted to nullity.
A statement signed by the State Publicity Secretary of the Agada-led exco, Daniel Ihomun, praised the judgement as landmark.
