Final Battle Looms as Kano Emirate Tussle Moves to Supreme Court 

The Court of Appeal in Abuja on Tuesday overturned previous rulings that obstructed the reinstatement of Muhammadu Sanusi II as the 16th Emir of Kano, setting the stage for a decisive legal battle at the Supreme Court.

A three-member panel led by Justice Biobele Abraham Georgewill ruled unanimously, acknowledging that the case records had been transmitted to the Supreme Court. The court directed all parties to exercise restraint until the apex court delivers its judgment.

During the hearing, Kano State Government’s counsel, Ibrahim Wangida, informed the court of a notice of appeal challenging the stay of execution issued on March 14, 2025. He stated that all necessary legal processes, including transmitting the case records, had been completed.

By legal precedent, the transmission of appeal records automatically halts any further action on the Court of Appeal’s earlier ruling of March 14, 2025.

Justice Abang had previously ordered a stay of execution on Sanusi II’s reinstatement, instructing all parties to maintain the status quo ante bellum, effectively reverting the situation to what it was before the trial court’s ruling on June 13, 2024.

Dissatisfied with this decision, Kano State Government’s legal team argued that the ruling misinterpreted constitutional provisions, emphasizing that an appeal was already before the Supreme Court.

Meanwhile, Abdul Fagge (SAN), representing the opposing party, did not contest the notice of appeal, stating that the respondent acted within constitutional limits.

The Kano Emirate crisis began with the enactment of the Kano State Emirate Council (Repeal) Law 2024, which removed Aminu Ado Bayero as the 15th Emir and dissolved four additional first-class emirates created by former Governor Abdullahi Ganduje. Following this, Sanusi II was reinstated by the Kano State Government.

However, Bayero returned to Kano and took refuge at the Nassarawa mini palace under heavy security while contesting his removal in court.

With the case now before the Supreme Court, a final ruling on the Kano Emirate dispute is imminent.
