THE Court of Appeal, Sokoto Division, has upheld its previous ruling regarding the unlawful dethronement of the 19th Emir of Gwandu, Al-Mustapha Jokolo.
This ruling makes it the second time the Kebbi State government has lost an appeal against the lower court’s decision, which reached the same conclusion.
Justice Tobi expressed approval of the earlier ruling made by Justice Abbas Ahman of the Kebbi State High Court, stating that the removal of the 19th Emir was illegal and did not comply with due process.
The judge declared Jokolo’s dethronement null and void, highlighting that he was not afforded a fair chance to defend himself against the accusations made against him, which violated his fundamental human rights as a citizen.
Jokolo was removed from his position as Emir of Gwandu by the Kebbi State Government in June 2005 during the administration of former Governor Muhammadu Adamu Aliero.
Justice Tobi reiterated the decision reached by Justice Abbas Ahman, stressing that the removal was unlawful and that due process was not followed.
