A Chief Magistrate Court sitting in Bwari, Federal Capital Territory, has adjourned indefinitely a case between a United States-based security firm, BCGNEEDS Company, and Mr Bright Echefu, owner of Briech Intelligence Fusion Limited.
BCGNEEDS Company had sued Echefu for allegedly breaching a $651,280 security contract agreement.
Earlier, on November 19, 2024, the Chief Magistrate, Okechukwu John Akweke, ordered Echefu’s arrest for failing to appear before the court to defend the allegations.
Echefu’s lawyer informed the court that his client was not available and requested that the court allow him time to produce the defendant upon his return.
However, at the continuation of proceedings in the case, counsel to BCGNEEDS, Barrister John Paul Eze, told the court that Echefu had not appeared in court for the last two adjournments.
Eze noted that on the previous adjourned date, Echefu’s lawyer had pleaded with the court that he would appear on December 9, 2024.
Eze equally told the court that Echefu filed a motion at a higher court seeking a review of the Magistrate Court’s order.
Responding to the submission, Chief Magistrate Akweke advised Eze to file the necessary documents at the higher court to challenge Echefu’s application.
The Chief magistrate stated that the matter was already before a higher court and as as such, the Magistrate court could not proceed unless it was referred back by the superior court.
“If the higher court sends the case file back to this court, the case will continue. In the interim, this case is adjourned sine die,” the chief Magistrate ruled.
In the originating summons, BCGNEEDS had informed the court that Echefu’s company, Briech Intelligence Fusion Limited, allegedly breached a contract agreement for the supply of drones and accessories.
BCGNEEDS said it entered into an agreement with Echefu’s company for the supply of drones and accessories worth $651,280 via a Local Purchase Order with Ref: BIFC/LPO/TS/ABJ/088106 dated October 21, 2022.
However, according to BCGNEEDS, after the delivery of the drones and accessories, the company was no longer able to reach Echefu.
